Two probation reports, one contradicting the other, have led to a father and his son being separated and the estranged mother having full control of the minor.The father, Osey Hendricks, 36, and the mother, Petal Roberts, 37, shared a union for some 18 years. That union produced three children, the youngest being, Osey Roberts, now 11. This is the youngster who is now the centre of a dispute.Hendricks and Roberts developed their relationship when they met in Charlestown way back then but charges of infidelity caused them to go their separate ways.According to one probation report, Roberts kept denying any allegation of infidelity. When the separation came the children, girls, went to live with their mother but two days later the boy called his father and asked to be taken out of his present situation.He reportedly expressed an objection to sleeping under crowded conditions. He left with his father with the consent of the mother.It was not long before the mother moved to the courts for custody of her son. Justice Brassington Reynolds heard the woman’s petition and ordered a probation report.Probation Officer, A. Sharma, wrote, “The respondent is residing with his son at Lot 4646 Roxanne Burnham Gardens in a one-room apartment.“From his weekly earnings of $18,000 as a chauffeur he realized the monthly rental as well as the material needs of himself and his son.The respondent does not entertain any female company at his residence.“From all indications both the applicant and respondent have a deep love and attachment for the child. The well-mannered child loves his parents and needs their love and not to be caught up in a divisive struggle that will cause confusion in his young mind.”The probation officer asked the court to be prudent in its decision so that the child “can have the love, guidance, security and discipline for his optimal development and growth.”That was written on December 7, 2010. However a second probation report written on October 24, last, when Justice Dawn Gregory heard the matter noted, “The applicant (Petal Roberts) has access to her son but is asking for more opportunity to be meaningfully involved in his life.“The respondent (Osey Hendricks) however, is not happy to have the child visit his mother’s home for long periods since he feels that the home environment will have a negative impact on his child’s welfare.” The probation officer concluded that Roberts’s parenting and home environment was satisfactory.Then came the section of the report that might have influenced the court. “What appears to be not satisfactory is the fact that the child spends much time alone in a room while he awaits his father.”The officer, Deneise Ralph, contended that the child was therefore being denied assistance with homework.“The mother appears to have a more conducive home environment for the much needed development of the child…It is felt that the child would benefit tremendously if he is allowed to live with his mother and sisters.”The child is with the mother but his father is dissatisfied. He claims that his son is not enjoying the best.
