Murder accused Kumar Ranji Singh, 48, a cane cutter of 6th Street, Johns, Port Mourant, Corentyne was on Wednesday sentenced to 10 years in jail by Justice Diana Insanally in the Berbice High Court.The man who is charged with murdering his wife Yaswattee Samaroo called Sunita on Friday 23 July, 2010 at Johns Port Mourant had pleaded not guilty to murder, but guilty to the lesser count of manslaughter when he first appeared before  justice Insanally on  January 7.On that occasion a probation report was ordered by his lawyer Attorney at law Kim Kyte.However, before the report was presented, State Prosecutor Attorney at Law Renita Singh presented her opening statement to the court.Singh told the court that the accused and deceased lived together for more than 26 years, after which they started to encounter marital problems , forcing her to move out.On the day in question, at about 15:30hrs the accused left his home to go to the shop. During the journey,China NFL Jerseys, he saw his wife and daughter and engaged them in conversation. He begged his wife to return home and she refused. The man had stated in a caution statement that his wife then became physically abusive, took out a knife and tried to bore him. He said he took away the knife and they both fell to the ground.He said he saw blood on her neck and he told her he would kill himself. The man then returned to his home and tried to hang himself in his house but the police arrived and cut him down. He was subsequently hospitalized at the Port Mourant, New Amsterdam and Georgetown hospitals.A blood-stained knife suspected to be the murder weapon, was recovered by the police.The daughter had given a statement as to seeing her father injuring her mother with the knife. She had stated that she saw when her father took out the knife from a ‘black socket’ which was in  a red plastic bag.The couple’s son had also given a statement that after his mother had moved out, his father had asked him to convince his mother to return home.   He had seen his father with a knife which he had told him he would use to kill his mother. He had subsequently seen the knife with blood in a drawer after the incident. He had informed the police who collected the weapon.A post-mortem examination which was conducted by Dr. Vivekanand Brijmohan revealed that the woman died from shock and hemorrhage due to an incise wound to the neck.The probation report which was presented by Senior Probation and Social Service Officer Claudia Munroe had stated that the accused was the third of five children. It stated that the accused hadn’t much education having left school at age 12 to work at a rice mill and catch fish.He became a cane cutter at age 17. He could not read and write and learnt to do so while in prison. He had previous brushes with the law and he and his wife had a rocky relationship. It was also established that he was a constant user of alcohol and became abusive whenever he was drunk.Singh had told the court that he is a baptized Christian on ‘a plea of mercy.’ He said that he worked hard and honest as a cane cutter for a number of years.His attorney Kim Kyte in a lengthy and passionate plea asked the court to temper justice with mercy. The attorney quoted a number of authorities in her mitigation plea. She said that not in all cases of domestic violence is the male partner at fault. “In this case both were at fault. My client has marks of violence to show that he was wounded by the deceased.”  She mentioned.Justice Insanally before handing down sentence stated that she had taken all that was said into consideration by both the prosecution and defence attorneys, as well as the probation report.She then said that she will start with a 17 year sentence, minus the three and a half years already spend in jail, another two for the plea of mitigation and another one and a half for other mitigating factors which resulted in 10 years.Singh, after being sentenced thanked the judge. He was seen smiling and mumbling to himself. He hugged his family. Outside of the court room his elderly mother broke down in tears and was comforted by other family members.In the Magistrate Court the accused had wept bitterly and had mentioned that his wife used to beat him but claimed he was ashamed to tell anyone.Singh was accused of stabbing Samaroo to death in front of their nine year- old daughter in front of a grocery store, not too far from her home at John, Port Mourant, after she and the child had left to go to the shop.
